Binding Agreement
This is a binding agreement. By using the website located at www.ATTKTX.com (the “Site”) or any services provided in connection with the Site (the “Service”), you agree to abide by these Terms of Use, as amended by ATTKTX® (“Company”) from time to time in its sole discretion. Any updates will be posted on the Site. It is your responsibility to review these Terms periodically. If you find them unacceptable, you must immediately leave the Site and cease use of the Service.

By using the Service, you represent that you are at least 18 years old and legally able to enter into this agreement.

Privacy Policy

Company respects your privacy and allows you to control the treatment of your personal information. Our full Privacy Policy is available here and is incorporated into these Terms by reference.

When creating an account to use the Site or Service, you must provide complete and accurate information. You are responsible for maintaining the confidentiality of your password and may not use someone else’s account. Notify the Company immediately of any unauthorized use. Company is not liable for losses caused by unauthorized use of your account, and you may be held liable for any resulting damages to Company or its affiliates.

Use of Software

The Company may provide software for download from the Site. Any software, including associated files, images, and data (collectively, “Software”), is licensed to you for personal, non-commercial use only. The Company retains all ownership and intellectual property rights. You may not sell, redistribute, reproduce, decompile, reverse-engineer, or otherwise convert the Software into a human-perceivable form. All trademarks and logos are owned by the Company or its licensors and may not be copied or used without permission.

User Content

By posting, uploading, or distributing content (“User Content”) on the Site or Service, you grant ATTKTX® a license to use, reproduce, display, distribute, edit, translate, and otherwise handle the content in connection with Site operations. You will not receive compensation for User Content. You represent that you own or are authorized to use the rights for any content posted.

Compliance with Intellectual Property Laws

You agree to respect intellectual property rights and not to upload or share content that violates copyrights, trademarks, or other proprietary rights. You are responsible for any violations caused by content you provide or transmit.

Prohibited Content

You may not upload or distribute content that is libelous, defamatory, obscene, pornographic, abusive, threatening, or encourages illegal activity. Company may remove such content or terminate access to the Site or Service. We cooperate with law enforcement as necessary to investigate violations.

Copyright Infringement

Company follows procedures to address alleged copyright infringement. Users who infringe intellectual property rights may have their accounts suspended or terminated. To report infringement, provide:

Identification of the copyrighted work.
Identification of the infringing material.
Contact information (address, phone, email).
Statement of good-faith belief that the use is unauthorized.
Statement that the notification is accurate and authorized under penalty of perjury.

Alleged Violations

Company may access your account to investigate complaints or violations. Accounts may be terminated immediately if the Company determines a breach of these Terms or misuse of the Service.

No Warranties

The Site and Service are provided “as is.” Company disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not guarantee uninterrupted or error-free operation of the Site or Service.

Typographical Errors

If an incorrect price is listed, Company may refuse or cancel the order. Refunds for canceled orders will be issued for the amount charged.

Warnings and Safety

Paintball markers and components are not toys. Follow all safety rules, warning labels, and product instructions. Use a qualified technician for installations, modifications, or repairs.

Limited Liability

Company’s liability is limited to the maximum extent permitted by law. We are not liable for any damages, including incidental, consequential, or lost profits, arising from your use of the Site or Service.

Affiliated Sites

Company is not responsible for third-party sites linked to our Site. Content, products, or services offered by partners are subject to their own terms and policies.

Prohibited Uses

You may not attempt to breach security, access unauthorized accounts, interfere with the Site, transmit viruses, send spam, or reverse-engineer the Site or Service. Violations may result in civil or criminal liability.

Indemnity

You agree to indemnify and hold harmless Company, affiliates, and representatives from claims, damages, or costs arising from your use of the Site, violation of these Terms, or infringement of intellectual property.
